Students Are Tenants — With Full RTA Rights
A lot of bad advice circulates in student-rental circles. Getting this wrong is how landlords lose hearings, so here is the accurate version.
A Fixed Term Does Not End the Tenancy
When an 8- or 12-month term expires it does not evict anyone. The tenancy automatically continues month-to-month unless the tenant gives proper written notice and leaves, or both sides agree in writing to end it. Plan turnover around notice, not around the calendar.
Off-Campus Is Not Exempt
Residences operated by a post-secondary institution can be exempt from parts of the Residential Tenancies Act. An ordinary off-campus student house or apartment is not. Calling a lease a “student lease” changes nothing about the rules that apply to it.
Guarantors Are Legitimate
Asking for a co-signer or guarantor is common, lawful, and sensible where an applicant has little income or credit history. What matters is that the guarantee is properly documented and that the guarantor was actually screened.
Removing a tenant in Ontario requires the correct notice, a Landlord and Tenant Board application, and a hearing. Non-payment matters typically resolve in roughly 60–90 days depending on LTB scheduling. Anyone promising faster because “they’re just students” is selling you a losing hearing.
