About these Terms

These Terms of Use apply to your access to and use of the public website at ontariolandlordhelp.ca (the “Site”), which is operated by Rent4All Property Management Inc., operating as OLH Property Management (“OLH”, “we”, “us”). By using the Site you agree to these Terms, together with our Privacy Policy. Please read them. If you do not agree, please do not use the Site.

These Terms do not override any signed service agreement between you and OLH, or any recorded consent you give through the Site (for example in the SIREG Owner Registry or the Owner & Tenant Connection Centre). Signed agreements govern paid services; recorded consents govern their own subject matter. In the event of a conflict, the signed agreement or recorded consent governs.

General information, not professional advice

The Site provides general information about Ontario residential property management and about the services OLH offers. It is not legal, investment, tax, accounting, financial, real-estate or paralegal advice. Simply viewing or reading the Site, by itself, does not create a professional-client relationship with OLH or anyone at OLH. If you already have a signed service agreement with OLH, or a recorded consent through a Site registration, that relationship continues to be governed by the agreement or recorded consent and is unaffected by this paragraph. Your situation depends on your own facts and documents; please get independent professional advice before acting on anything you read here.

Separate businesses and roles

OLH operates its own property-management business. Other businesses associated with Paul J. Rouillard — for example List It Realty Brokerage Inc. (a separate, licensed real-estate brokerage) and LandlordEzy (property-management software) — are separate legal entities, offer their own services under their own terms, and act in their own capacity. Where OLH links to one of them, the service you receive from the linked business is theirs, not OLH’s. Nothing on the Site should be read as blurring these roles.

Paul J. Rouillard is the Broker of Record of List It Realty Brokerage Inc. Any licensed real-estate services are offered through List It Realty Brokerage Inc. on its own terms, separately from the Site and from OLH’s property-management services, and separately from any investment or security matters.

No securities, investment or financial-advice services

OLH is not acting, through the Site or otherwise, as a registered securities dealer, investment adviser, law firm, financial adviser or real-estate brokerage in connection with any SIREG Management Inc. or The Simple Investor investment, security or offering. OLH does not endorse, guarantee, underwrite, offer, sell, solicit or recommend any such investment, security, offering, projected return, yield or financial outcome. OLH and SIREG Management Inc. and The Simple Investor are separate legal entities.

Information on the Site about any investment-related situation is a general summary of identified public or official sources, or of material OLH has received and labelled as submitted material. It is not a solicitation, an offer to sell or an offer to buy any investment or security, and is not personalized advice.

Third-party links and materials

The Site may link to or refer to materials controlled by third parties, including news reports, regulator releases, legal memoranda, external portals, offering memoranda, partner marketing or investment materials. Those links and materials are governed by their providers’ own terms and privacy practices. OLH does not control, verify, endorse or assume responsibility for them, or for any investment, decision or transaction resulting from them.

Investment risk

Investments carry risk, including possible loss of principal. Past performance does not guarantee future results. You are responsible for your own investment, legal, tax and financial decisions, and should seek independent professional advice.

Your decisions and your use of the Site

Information on the Site is provided to help you understand options; what you do with it is up to you, and you remain responsible for complying with your agreements and with applicable law. Please use the Site lawfully and in good faith: do not interfere with it, do not try to access it in ways it was not intended to be accessed, and do not use it to post content that is unlawful, misleading or infringing. If a page asks for information you give voluntarily (for example a registration form), please give accurate information.

Corrections and feedback

If you believe a statement of fact on the Site is inaccurate or incomplete, email info@olhgroup.ca with the page address, the statement and any supporting information. OLH reviews correction requests supported by relevant information.

Limitation of liability and reliance on third-party materials

To the fullest extent permitted by law, the Site and its content are provided on an “as is” basis, without warranties of any kind, express or implied. OLH is not responsible for errors or omissions in content, for third-party links or materials, or for decisions you make based on information on the Site.

To the fullest extent permitted by law, OLH is not liable to you for any loss arising from your reliance on third-party links, offering memoranda, partner marketing, investment materials or other third-party content accessed through or referred to by the Site; any claim you have in connection with such third-party content is a matter between you and that third party. Nothing in this paragraph limits OLH’s own liability for its own gross negligence or wilful misconduct, or any liability that cannot be limited or excluded by law.

Your use of the Site

To the fullest extent permitted by law, you agree to indemnify and hold OLH harmless from third-party claims, losses and reasonable legal costs that arise directly from (a) your unlawful misuse of the Site, or (b) your unauthorized alteration, redistribution or republication of content from the Site. This indemnity does not apply to claims arising from OLH’s own gross negligence or wilful misconduct, or to any liability that cannot be limited or excluded by law, and it does not apply to your ordinary, lawful personal use of the Site or ordinary sharing of a link to a page as published.

Scope and precedence

These Terms do not exclude or limit any liability or right that cannot by law be excluded or limited, and do not state that these Terms prevent you from bringing a lawsuit; where applicable law gives you a right to make a claim, that right is not affected. If any part of these Terms is held to be unenforceable, the rest continues to apply, and the unenforceable part is read down to the minimum extent necessary.

Changes

OLH may update these Terms from time to time. Updates take effect when posted; the “Last updated” date above shows when they were last changed.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario have non-exclusive jurisdiction over any dispute arising from the Site, subject to any mandatory consumer-protection rules of your place of residence.
